Tutkielman tavoitteet pohjautuvat demokraattisten yhteiskuntien kasvavien illiberaalien taipumusten kriittisestä pohdinnasta. Tutkielmassa keskityn siihen, miten tiettyjen naisten oikeuksien vähentäminen ja poistaminen esitetään edistyksellisissä ja feministisissä diskursseissa niiden poliittisten vaikutusten osalta, jotka heikentävät demokraattisia periaatteita ja yhteiskuntaa. Keskityn tarkastelemaan tätä ongelmaa kahden Yhdysvaltalaisen oikeustapauksen, Roe v. Wade ja Dobbs v. Jackson Women’s Health Organization pohjalta. Tutkielman aineisto pohjautuu akateemisiin keskusteluihin, joita käydään The New York Timesin politiikka-aiheisessa podcastissa The Ezra Klein Show’ssa. Analyysi toteutetaan kriittisen sisällönanalyysin ja käsitteellisen analyysin yhdistelmällä, heijastaen Drucilla Cornellin feministisen oikeusteorian the imaginary domain - käsitettä. Analyysi artikuloi lisääntymisvapauden merkitystä demokratialle institutionaalisuus-, tasa-arvo- ja vapausnäkökulmasta. Hyödyntämällä asiankuuluvaa keskustelua, tämä tutkielma tuo esiin Roe v. Wade -tapauksen kumoamisen seuraukset laajempiin sosiaalisiin, poliittisiin ja oikeudellisiin seurauksiin sukupuolten tasa-arvolle ja demokraattisille periaatteille Yhdysvalloissa. Näin ollen tämä tutkielma lisää tietoa rajoittavien sukupuolikohtaisten käytäntöjen vaikutuksista vakiintuneissa demokratioissa. Drucilla Cornellin viitekehykseen sijoitettuna analyysi osoittaa, että The Ezra Klein Show’n Dobbs v. Jackson -tapausta koskevaan keskusteluun osallistuneiden kriitikoiden mukaan ilman lisääntymisvapautta on mahdotonta saavuttaa vapautta ja tasa-arvoa kaikille kansalaisille yhteiskunnassa. The aim of this thesis is to analyse arguments that reproductive freedom is essential to participatory democracy in the wake of the annulment of the constitutional rights to abortion in the United States in 2022. The aim is motivated by critical reflections about growing illiberal tendencies that are undermining prerequisite for participatory democracy, particularly effecting women and minority groups. It focuses on how reduction and elimination of certain women’s rights are presented in progressive and feminist discourses in terms of their political effect of weakening of democratic principles and society. This thesis focuses to examine this problem reflecting two legal cases in the United States: Roe v. Wade and Dobbs v. Jackson Women’s Health Organization. The research material of the thesis are academic debates held on a political podcast The Ezra Klein Show. The analysis is conducted within a combination of critical contents analysis and a conceptual analysis, reflecting the research issue within Drucilla Cornell’s feminist legal theory of the imaginary domain. The analysis articulates the significance of reproductive freedom to democracy from three perspectives: institutional, equality and freedom centred. By drawing on a relevant debate, this thesis brings attention to the broader social, political and legal ramifications of abolishment of Roe v. Wade for gender equality and democratic principles in the United States. Thus, this thesis contributes broader knowledge about the implications of restrictive gender-specific policies in well-established democracies. Positioned within the framework of Drucilla Cornell’s, the analysis shows that according to the critics who participated in the debate on Dobbs v. Jackson on The Ezra Klein Show, without reproductive freedom it is impossible to achieve freedom and equality for all the citizens in the polity.
